There is of course an alternative that was not explored in this
discussion, or if it was, I missed it.

You can simply rewrite the programme as a community project. I don't
know what the programme is or the community that it services, but this
might be an opportunity to update the whole project and enlarge the
community of users at the same time.

That avoids the whole ethico-legal debate entirely.
