Implementing encryption at the IP level, as was originally intended
for IPv6 (and may still be), would stop these sorts of bills in
their tracks.
As is, there are already plenty of tools to hide one's tracks and
correspondence. Some terrorist leader could easily be exchanging PGP
encrypted e-mails with contacts around the world and nobody would be
the wiser. Clamping down on privacy only hurts the legitimate people.
Personally, although not a criminal (as far as I know) or a terrorist,
I encrypt everything I can, whenever I can, and I encourage others to
do the same.
When privacy is criminal, only criminals will have privacy. :)
