This issue is mostly one of public awareness.

The "open" nature of Free and Open Source software may in fact be your 
best hedge against patent and copyright infringement suits. This will 
hopefully come to light as the SCO case unfolds. I've posted this link 
before, but so far it's the best article on how the law really works in
